The time has come when litigation to resolve disputes is no longer featured or the primary method to resolve disputes. There are healthier, cheaper, confidential methods to resolve disputes in franchising. While Parker & Associates has always provided some of these methods, our service offering is now broader and more explicit.

Franchise disputes are gaining notoriety as franchisors continue to adapt to changing economics, greater competitiveness, new supply chain options, tougher disclosure negotiation and powerful franchisee business associations. Disputes may weigh heavily on new franchisee recruitment and customer perceptions of the brand. Lengthy disputes cause management distress and some bleeding of the corporate culture.

Some disputes require legal counsel to be involved and others suffer because of aggressive legal stances that can inflame disputes. In my experience many disputes can be resolved by engaging someone who, while not a lawyer, is highly experienced in franchising. Someone with professional integrity , a widely known reputation and who has significant experience in assisted negotiation methodology. Someone who knows how a franchise system really works because he has been there (including almost 20 years with a growing McDonald’s chain). Someone who understands the franchisee’s point of view as well.
